1. Introduction

Welcome to Bistux Solutions Pvt Ltd . These Terms and Conditions govern your relationship with Ainvox  operated by Bistux Solutions Pvt Ltd.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Services Provided

Bistux Solutions Pvt Ltd provides cloud telephony services, including but not limited to VoIP (Voice over Internet Protocol) services, call management, and other related services.

3. User Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

4. VoIP Regulations Compliance

Our VoIP services comply with the regulations set forth by the Telecom Regulatory Authority of India (TRAI). Users must ensure that their use of the Service adheres to all applicable laws and regulations, including but not limited to:

  • Registration and Licensing: Users must ensure they have the necessary licenses and registrations as required by TRAI.
  • Call Recording: Users must comply with local laws regarding call recording and privacy.
  • Emergency Services: VoIP services may have limitations in providing access to emergency services. Users should ensure they have alternative means to access emergency services.

5. Payment Terms

Users agree to pay all fees associated with the use of the Service as per the pricing plans selected. All payments are due in advance and are non-refundable.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Bistux Solutions Pvt Ltd and its licensors.

7. Data Protection and Privacy

We are committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and disclose information that pertains to your privacy. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

8. Data Usage Policies

9. Legal Documents Required for KYC

To comply with Know Your Customer (KYC) regulations, users must provide the following documents:

  • Proof of Identity: A valid government-issued ID (e.g., Aadhaar card, passport, driver’s license).
  • Proof of Address: A recent utility bill, bank statement, or rental agreement.
  • Business Registration Documents: For business accounts, a copy of the business registration certificate and PAN card.

10. Use of Virtual Phone Numbers (DID)

  • Provision of DID Numbers: We provide Direct Inward Dialing (DID) numbers for use with our services. These numbers are subject to availability and regulatory compliance.
  • Usage Restrictions: Users must not use DID numbers for any unlawful activities. Misuse of DID numbers may result in termination of services.
  • Privacy: We ensure the privacy of your virtual phone numbers and protect them from unauthorized access.

11. Responsible Use of Services

  • Making and Receiving Calls: Users must use the Service responsibly and in compliance with all applicable laws and regulations. This includes not engaging in fraudulent, abusive, or illegal activities.
  • Call Quality: Users are responsible for ensuring they have a stable internet connection to maintain call quality.
  • Customer Support: Users should contact our customer support team for any issues or concerns regarding the Service.

12. User Responsibility for Misuse

Users are legally responsible for any misuse or fraudulent activities conducted using the phone numbers and other resources provided by the Service. This includes any actions taken by the user or anyone who has access to their account. Users must ensure that their account credentials are kept secure and confidential.

13. Use of Autodialers and Call Campaigning Tools

Autodialers and call campaigning tools provided by the Service are only allowed to send automated calls to recipients who have given written permission to receive such calls from the user. Users must ensure they have obtained and can provide proof of such permissions.

14. Promotional Calls

No promotional calls are allowed to any numbers unless the recipients have given written permission to receive such calls from the user. Users must ensure they have obtained and can provide proof of such permissions.

15. No Warranty

  • No Warranty on Services: The Service, including virtual phone numbers, IVRs, call campaigners, APIs, and other tools, is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, secure, or free from errors.
  • No Liability for Loss or Damage: We are not liable for any loss or damage to any resources inside and outside of the platform. This includes, but is not limited to, data loss, security breaches, or service interruptions.
  • No Warranty on Uptime: While we strive to ensure the Service is available at all times, we do not guarantee any specific uptime or availability. Users acknowledge that the Service may be subject to interruptions or downtime.

16. Limitation of Liability

In no event shall Bistux Solutions Pvt Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

17. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

18. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

19. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
